St Kilda's Leigh Montagna has had his case thrown out after they MRP admitted to making a mistake in suspending him in the first place.

https://twitter.com/#/AFL_PKeane

Quote:
Leigh Montagna Tribunal Charge withdrawn this afternoon by AFL legal counsel Jeff Gleeson. Montagna now clear to play v Hawthorn in rd six.

Gleeson was made aware St Kilda would call J Magner as part of Montagna defence, with evidence contact was caused by an accidental knee.

How can we have an internal judicial system for this country's biggest professional sport making mistake after mistake.

It's beyond embarrassing now, and something has to be done about it.

When will the AFL realise that the MRP and Tribunal are an absolute joke? What would the AFL have done if Montagna had accepted the two weeks in the first place? I can smell a legal challenge coming sooner rather than later the way this isht is heading...

So what was the reason for it being withdrawn without even facing the tribunal? Not sure I understand.

Have a look at the report and try to figure out what case the AFL could argue... I'm still struggling to figure out what he was actually reported for.

Edit: If it was a knee, it certainly didn't look deliberate. If it was, probably the best disguised action, well, ever.

I'm sorry, I still don't understand. Who is J Magner? And why was the mere threat of him being called sufficient to cancel a tribunal hearing?

Surely the proper process would be to have the hearing and have it resolved then. If Montagna has no case to answer, that's the tribunal's job to figure it out and overrule the MRP if necessary. Is Gleeson some kind of shadowy Emperor Palpatine figure? And does anyone have Youtube video of the incident?

Didn't they stop asking opposition players to give evidence years ago because of the well-known fact that they would always either defend the accused or claim ignorance?

I'm struggling to understand how that was St. Kilda's trump card.

All very bizarre.

I don't follow your reasoning.

The MRP should be sacked. What a joke. How can you suspend a bloke one day, then change your mind the next?

I guess at least they had the guts to admit they were wrong; still, I'd like to hear their reasoning (so far, it's clear as mud).

Here's the video, for others wondering about the actual incident.

This is their reason;

http://www.afl.com.au/news/newsarticle/tabid/208/newsid/134615/default.aspx

Quote:
"Mr Montagna and Mr Magner both informed me that the only significant contact from Montagna to Magner was contact from Montagna’s knee to the cheek of Magner.

"They both said that Magner pulled Montagna to the ground and in the course of, or immediately after, that happening Montagna’s knee accidentally knocked Magner’s cheek.

"I conducted a further review of the video evidence in light of this explanation and it is consistent with the explanation."

Chris Pelchen, St Kilda's head of football, said the Saints were pleased with the outcome.

"The club was confident of successfully challenging the charge laid against Montagna, based on its understanding of what actually occurred.

"We’re happy that after the AFL considered all the players’ evidence, the charge was withdrawn."
