The vital questions lingering over Ben Stokes's botched 'affray' trial ... [ctd.]
http://www.dailymail.co.uk/news/article-6072819/Vital-questions-linger-Ben-Stokes-trial-amid-dispute-police-CPS.html
"Why can’t anyone recall what went on?
To say that there were gaps in the memories of those involved in the fracas would be something of an understatement.
...
‘Mr Stokes, you seem to have a really significant memory blackout,’ prosecuting barrister Nicholas Corsellis suggested to him at Bristol Crown Court.
Stokes replied: ‘You could say that, yes.’
Given that Stokes had consumed at least ten alcoholic drinks on that night, including pints of lager, vodka and lemonades and Jagerbombs, was it because he was ‘actually really very drunk’?
Stokes strongly denied that was the case, adding: ‘I think the whole incident would have been clouded because it was such . . . there was a lot of people around . . . a lot of shouting. I don’t remember every little detail which has gone on that night.’
Mr Ali, meanwhile, had a similar problem recalling the details of the night. He told jurors his memory of the evening was ‘incomplete’ due to the head injury he suffered when he was knocked out.
As for Mr Hale, in a statement to police, he said he had suffered a mini-stroke a month before the incident. As a result his ‘short-term memory was not good’. " |

"Why didn’t witnesses give court evidence?
...
Their statements were not read to the jury and they were not called to give evidence.
There was plenty they could have helped to clear up — on oath — had they actually been asked.
...
Neither the prosecution nor the defence chose to call the pair —raising questions as to whether their story would have stood up to court scrutiny.
Sources confirmed to the Mail they had been deemed unreliable and that their recollection of events was ‘fluid’.
In an interview with The Sun following the trial, Mr Barry said: ‘Just a week before the case, the Crown Prosecution Service said they didn’t want us there. ...'
...
While Mr Barry and Mr O’Connor did not give evidence in court, on two occasions their version of events has been published in The Sun newspaper.
Their first interview was on October 28...
...
A second interview with the pair was published on Wednesday, the day after Stokes was acquitted.
In both interviews, the duo lavished praise on Stokes for stepping in to save them from homophobic bullies who were verbally abusing and physically threatening them.
But there were a number of discrepancies in what they said.
In the first interview, they said they met Stokes inside the Mbargo nightclub.
...
Significantly, the evidence in court established that Stokes did not, in fact, meet the men until they had left the nightclub.
...
... in their first interview, there was no mention at all of a bottle.
The pair’s repeated claims that they were subjected to homophobic abuse have riled Mr Hale, who issued a statement denying that was the case following the end of the trial.
‘Mr Hale denies that there was any animosity between the group throughout the evening, and he in fact left the Mbargo nightclub and greeted Mr O’Connor and Mr Barry in a friendly way, as supported by CCTV,’ it read." |

Ben Stokes & Alex Hales fined over Bristol fight
https://www.bbc.com/sport/cricket/46486977
"Neither Ben Stokes nor Alex Hales will miss any further England matches as a result of their part in a fight outside a Bristol nightclub in September 2017.
...
... Stokes ... has been fined a total of £30,000 and ... Hales £17,500, £10,000 of which is suspended for 12 months from now.
...
Their case was ruled on by the Cricket Disciplinary Commission, which is independent from the ECB.
As well as the incident in Bristol, Stokes answered a charge in relation to an "inappropriate video" on social media, while Hales was charged in relation to "inappropriate images".
Both men pleaded guilty to all charges.
It was decided Stokes should be banned for eight matches, all of which have been served, with Hales suspended for six white-ball matches, two of which have been served and the remaining four are suspended.
...
Hales must also undertake what is described as "appropriate training" at his own cost." |

On the allegedly unreliable witnesses: there are many broader questions here. e.g. when is it permissible for (potential) witnesses to be cavorting with the media? What are the relevant rules in different countries?

e.g. S. Australia's Office of the Director of Public Prosecutions just says:
"If you are a witness in criminal proceedings be aware that speaking with the media prior to the matter being finalised may result in your evidence becoming contaminated and/or compromising the case whilst it is still before the court. We therefore recommend that you give very careful consideration to this issue."

After Durham's appointment of Bancroft as captain comes this:
Ben Stokes commits to Durham on three-year deal
(It's a contract extension.)
Durham don't seem to worry much about character defects, do they? |

Ben Stokes: Bristol may be 'best thing that could have happened to me'
http://www.espncricinfo.com/story/_/id/26450245/bristol-best-thing-happened-me
"I used to love going out and celebrating with the lads. But we can do that in the hotel and I don't miss it. I don't feel that urge any more. Once you make the transition to not doing it then you don't miss it
"It's pointless. You get recognised and then, after someone has had a few ego boosters, a few vodka and whatevers, they feel they can come up to you and say whatever they feel. There are people ready to target you everywhere you go. I prefer staying in and chatting nonsense with my team-mates."
[The trial and verdict may have been the best thing that happened to Ben.] |

Saw him and Steve Smith batting together, in an IPL match, last night. Although Smith scored 70 odd, he was unable to launch, over the last two overs. _________________ Donny.

Hales & Stokes both made it into England's preliminary WC squad.
But cricinfo reports that Nottinghamshire has a statement on their website that
"Alex Hales has made himself unavailable for selection for personal reasons and no timetable has been set for his return to action". |

England's Alex Hales banned for recreational drug use
http://www.espncricinfo.com/story/_/id/26610779/england-alex-hales-banned-recreational-drug-use
"The England selectors are not thought to have known about the test result at the time the squad was announced.
According to a report in the Guardian, he is currently serving a 21-day ban after returning a second positive test, having pulled out of Nottinghamshire's Royal London Cup campaign, shortly after the World Cup squad was announced, for undisclosed personal reasons.
...
The drugs violation is understood to have been detected after Hales underwent a routine hair-follicle test, which all professional men's cricketers and centrally contracted women's players undergo at the start and finish of every season. The policy was introduced in 2013 in the wake of the death of Surrey's Tom Maynard, and can detect banned substances in the system for up to three months." |

A. Miller (cricinfo):
"... the situation is a personal tragedy for Hales, the circumstances of which will lean ever more heavily into the "duty of care" aspect of the ECB's policy regarding recreational drugs.
If, as has been suggested, Hales has been struggling since the Bristol trial, amid the divulgence of both his unsavoury role in the night's proceedings, and of details of his personal life that would not have come to light but for that new-found notoriety, then the punitive nature of the ECB's decision will do little to aid his state of mind.
He will therefore need close monitoring and support - from the PCA, from Nottinghamshire, and from the England team from which he has been so summarily drop-kicked - to ensure that the slippery slope, on which his two positive drugs tests already indicate he has stepped, does not become exponentially steeper in the coming weeks." |

Not sure how the ECB has "a duty of care" over the use of illegal drugs.
The pommy press was all over Warney over a bloody diet pill.
That said some of these drugs probably should be removed _________________ Annoying opposition supporters since 1967. |
